Welcome to Ultimate Bike Transport. These Terms and Conditions (“Terms”) govern your use of our website (https://ultimatebiketransport.co.za/) and the motorcycle transport services we provide. By accessing our Site, requesting a quote, or using our services, you agree to be bound by these Terms. Please read them carefully.

If you do not agree to these Terms, you must not use our Site or services.

1. Definitions

In these Terms, unless the context indicates otherwise:

  • “Company,” “we,” “us,” “our” refers to Ultimate Bike Transport.
  • “Customer,” “you,” “your” refers to the individual or entity requesting or using our services.
  • “Services” refers to all motorcycle transport, courier, and logistics services provided by Ultimate Bike Transport, including collection, transportation, and delivery.
  • “Motorcycle,” “Bike,” “Vehicle” refers to the motorcycle, scooter, or similar motorized two-wheeled vehicle entrusted to us for transport.
  • “Quote” refers to the estimated price provided to the Customer for the Services.
  • “Booking” refers to the confirmed agreement between the Customer and Ultimate Bike Transport for the provision of Services.
  • “Force Majeure” means any event beyond reasonable control, including but not limited to acts of God, war, terrorism, riots, civil commotion, strikes, lockouts, government actions, natural disasters, severe weather, or mechanical breakdown.

2.1 Scope of Services

Ultimate Bike Transport provides professional motorcycle transport services across South Africa and, where agreed, cross-border to neighboring countries. We offer nationwide coverage with a fleet equipped with real-time GPS tracking and secure cargo mounting systems.

2.2 Service Commitment

We are committed to providing safe, efficient, and personalized motorcycle transport services. Our drivers are professionally trained, licensed, and experienced. However, we do not guarantee specific transit times unless expressly agreed in writing, as delivery may be affected by factors beyond our control.

2.3 Quotes and Estimates

All quotes provided are estimates based on the information you supply. Final pricing may be adjusted if:

  • The actual weight or dimensions of the motorcycle differ materially from those provided.
  • Additional services (e.g., special handling, storage, or customs clearance) are required.
  • There are changes to the pickup or delivery locations or schedule.

3.1 Making a Booking

Bookings are confirmed when we provide you with a written confirmation (via email or our platform) and, if required, a deposit or full payment has been received.

3.2 Payment Terms

  • Payment terms will be specified in your quote or booking confirmation.
  • All fees are quoted in South African Rand (ZAR) unless otherwise stated.
  • Payment must be made via the methods specified on our invoice or Site.
  • We reserve the right to charge interest on overdue accounts at the maximum rate permitted by law.

3.3 Cancellation and Refunds

  • Cancellation by Customer: If you cancel a confirmed booking, cancellation fees may apply. The amount will be determined based on the stage of the service (e.g., administrative costs, dispatch costs). We will communicate this to you at the time of cancellation.
  • Cancellation by Company: We reserve the right to cancel or refuse any booking if we are unable to perform the Service due to operational constraints, safety concerns, or Force Majeure. In such cases, any payments received will be refunded in full.

3.4 Deposit

We may require a deposit to secure your booking. The deposit is non-refundable if you cancel within a specified period prior to the scheduled pickup, as communicated at the time of booking.

You warrant and agree that:

4.1 Ownership and Authority

You are the legal owner of the motorcycle or have the authority of the owner to enter into this agreement and have the motorcycle transported. You agree to provide proof of ownership or authority upon request.

4.2 Accuracy of Information

All information provided to us (including motorcycle details, pickup/delivery addresses, and contact information) is accurate and complete. You are responsible for any delays, additional costs, or damages resulting from inaccurate or incomplete information.

4.3 Vehicle Preparation

You are responsible for preparing the motorcycle for transport. This includes:

  • Removing all personal belongings, loose accessories, and custom parts not securely attached.
  • Ensuring the motorcycle is in a safe and transportable condition (e.g., no leaks, secure battery).
  • Providing a clear path for our driver to access and load the motorcycle at pickup and delivery locations.
  • Draining or reducing fuel to a maximum of one-quarter tank, unless otherwise agreed.

We are not responsible for damage to or loss of personal belongings left in or on the motorcycle.

4.4 Documentation for Cross-Border Transport

For cross-border services, you are responsible for providing all necessary customs, import/export, and vehicle registration documentation. We may assist with this process, but the ultimate responsibility for compliance with all applicable laws and regulations rests with you.

4.5 Dangerous Goods

You warrant that the motorcycle does not contain any dangerous, hazardous, or illegal goods. You will indemnify us against any loss, damage, or liability arising from a breach of this warranty.

5.1 Standard of Care

We will exercise reasonable skill and care in the provision of our Services. We will handle your motorcycle with the same level of care as we would our own property, using appropriate securing equipment and safe driving practices.

5.2 Insurance

We maintain cargo insurance for motorcycles in our care. The extent of coverage and any exclusions will be detailed in your booking documentation. We recommend that you arrange your own comprehensive insurance for the full value of your motorcycle, especially for high-value or classic bikes, as our liability may be limited.

5.3 Communication

We will make reasonable efforts to keep you informed of the progress of your shipment, including providing tracking information where available.

6.1 Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you for any claim, loss, or damage arising from or in connection with these Terms or our Services (whether in contract, delict/tort, or otherwise) is limited to the lower of (a) the amount paid by you for the specific Service, or (b) the insured value of the motorcycle as determined by our insurance policy or as agreed in writing.
  • We are not liable for any indirect, consequential, or special damages, including loss of profits, loss of use, or loss of opportunity.

6.2 What We Are Not Responsible For

We are not liable for:

  • Damage or loss arising from your failure to prepare the motorcycle as required.
  • Wear and tear, pre-existing mechanical faults, or damage resulting from the motorcycle’s inherent condition.
  • Delays or failures caused by Force Majeure events.
  • Theft or damage from circumstances beyond our reasonable control, including but not limited to criminal acts by third parties, provided we have taken reasonable security measures.
  • Damage to or loss of personal belongings or accessories not properly secured or not listed in the booking.

6.3 Indemnity

You agree to indemnify and hold us harmless against any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your breach of these Terms.
  • Any accident, injury, or damage caused by your motorcycle or your failure to prepare it properly.
  • Your violation of any applicable law or regulation.

6.4 Claims Procedure

If your motorcycle is damaged during transport:

  • You must note the damage on the delivery receipt (Bill of Lading) at the time of delivery.
  • You must notify us in writing within 7 days of delivery.
  • You must provide supporting evidence, including photographs and repair estimates.
  • We will then facilitate the claims process with our insurer. Failure to follow this procedure may affect your ability to claim.

All content on our Site, including text, images, logos, and graphics, is the property of Ultimate Bike Transport or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any content without our prior written consent.

8.1 Governing Law

These Terms and the relationship between you and Ultimate Bike Transport are governed by and interpreted in accordance with the laws of the Republic of South Africa.

8.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or our Services:

  • The parties shall first attempt to resolve the dispute through good-faith negotiations.
  • If the dispute cannot be resolved amicably within 30 days, either party may refer the matter to mediation or arbitration in Johannesburg, South Africa, in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
  • The decision of the arbitrator shall be final and binding.
  • Each party shall bear its own costs, and the costs of the arbitration shall be shared equally unless the arbitrator decides otherwise.

8.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts of the Republic of South Africa for any legal proceedings not subject to arbitration.

9.1 Entire Agreement

These Terms, together with any booking confirmations and invoices, constitute the entire agreement between you and us, superseding all prior agreements and understandings.

9.2 Amendments

We reserve the right to update these Terms from time to time. The revised Terms will be posted on our Site with an updated “Last Updated” date. Your continued use of our Site or Services after any changes constitutes your acceptance of the revised Terms.

9.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.4 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision in the future.

9.5 Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations due to a Force Majeure event. If such event occurs, the affected party shall notify the other party and take reasonable steps to mitigate the impact.

9.6 Assignment

You may not assign or transfer these Terms or any of your rights or obligations without our prior written consent. We may assign these Terms to an affiliate or successor entity.

9.7 Third-Party Rights

These Terms are for the benefit of the parties and their permitted assigns, and do not confer any rights on any third party.
